1. Acceptance of Terms

By downloading, installing, or using the Celefy mobile application ("App") or website, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. User Accounts

• To access certain features of the App, you must register using a Google Account ("Google Sign-In").
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You agree to provide accurate and complete information during the registration process.
• We reserve the right to terminate accounts that are inactive for an extended period or that violate these Terms.

4. Description of Service

Celefy provides event tracking, birthday reminders, digital cards, and AI-powered message generation.

AI Disclaimer

• The App uses artificial intelligence (Groq API) to generate celebration messages. While we strive for quality, AI-generated content may occasionally be inaccurate, inappropriate, or not aligned with your intended tone or message.
• You are solely responsible for reviewing, editing, and approving all AI-generated messages before sending them to recipients. Celefy is not responsible for any consequences arising from the use of AI-generated content.
• AI does not have access to your personal data (email, user ID) - only the message context you provide.
• We do not guarantee the availability, accuracy, or appropriateness of AI-generated content.

Service Availability

• Notifications: We use third-party services (OneSignal) to deliver reminders. We cannot guarantee 100% delivery due to factors outside our control.
• AI Service: AI message generation requires an active internet connection and depends on third-party AI service availability (Groq API). Service may be temporarily unavailable.
• Uptime: While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service.

5. User Content and Conduct

• You retain ownership of the data (birthdays, notes, photos) you input into the App. By inputting data, you grant Celefy a worldwide, non-exclusive license to use, store, and display this content solely for the purpose of providing the Service to you.
• Data Export: You may export your birthday/event data at any time through the App's export functionality (if available) or by contacting us at support@celefy.app.
• Prohibited Activities:
  1. Use the App for any illegal purpose.
  2. Harass, abuse, or harm another person.
  3. Upload content that is offensive, defamatory, or infringes on intellectual property rights.
  4. Attempt to reverse engineer, decompile, or extract the source code of the App.
  5. Use the App to distribute spam or malicious content.

6. Payments & Subscriptions

• Current Service: Celefy is currently free to use. All core features are available at no cost.
• Future Paid Features: Some features may become paid in the future. If we introduce paid features:
  • All pricing and billing terms will be clearly disclosed before purchase
  • You will be notified of any changes to pricing at least 30 days in advance
  • Existing free features will remain free unless explicitly stated otherwise
  • Subscription terms, cancellation policies, and refund policies will be clearly stated
  • Payment processing will be handled by secure third-party payment processors (e.g., Google Play Billing)
• Refunds: Refund policies will be disclosed at the time of purchase and will comply with applicable app store policies and local consumer protection laws.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Celefy and its licensors. The App is protected by copyright, trademark, and other laws.

8. Privacy Policy

Your use of the App is also governed by our Privacy Policy, found at https://celefy.app/privacy. By using the App, you consent to the terms of the Privacy Policy.

9. Third-Party Links and Services

The App may contain links to third-party websites or services (e.g., Google, OneSignal) that are not owned or controlled by Celefy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

10. Limitation of Liability

In no event shall Celefy, its developers, directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service;
2. Any conduct or content of any third party on the Service;
3. Any content obtained from the Service.

Disclaimer: The App is provided on an "AS IS" and "AS AVAILABLE" basis.

Liability Cap:

To the maximum extent permitted by law, Celefy's total liability for any claims arising from your use of the Service shall not exceed the amount you paid to Celefy in the 12 months preceding the claim, or $100 USD, whichever is greater.

Force Majeure

Celefy shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, internet outage, third-party service failure, or other causes beyond our reasonable control.

11. Indemnification

You agree to defend, indemnify, and hold harmless Celefy and its licensee and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from your violation of these Terms or your use of the Service.

12. Termination

User-Initiated Termination:

You may delete your account at any time through the App's Settings > Delete Account feature. Upon deletion:

• Your account and all associated data will be removed as described in our Privacy Policy (Section 5)
• You will lose access to all features and data
• This action is permanent and cannot be undone

Company-Initiated Termination:

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation:

• Violation of these Terms
• Illegal activity
• Fraudulent use of the Service
• Extended account inactivity

Upon termination, your right to use the Service will immediately cease, and we may delete your account and data in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

International Users:

If you are located outside Pakistan, certain consumer protection laws of your jurisdiction may provide you with additional rights. Nothing in these Terms limits any rights you may have under applicable local laws that cannot be waived by contract.

Dispute Resolution:

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Pakistan, unless mandatory consumer protection laws in your jurisdiction require otherwise.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
